These terms are a starting draft written against what the extension does. They have not been reviewed by a lawyer.

1. What these terms cover

SHUTTERPARTY is a Twitch Extension. Using it — pressing the button as a viewer, or installing and configuring it as a broadcaster — means accepting these terms.

Twitch's own Terms of Service and Community Guidelines apply to everything that happens on Twitch, including this extension. Where they and these terms disagree, Twitch's take precedence.

2. What the extension does

Viewers press a button; the broadcaster's own software photographs a moment of their stream and shows it on the broadcast. Bits advance a shared goal; reaching it starts a period during which every viewer may photograph freely.

The photographs are produced on the broadcaster's computer. We do not capture them, receive them, or store them.

3. Bits

Bits are Twitch's product, bought from Twitch, and are governed by Twitch's terms. We do not sell them and we cannot refund them.
Every product this extension offers is a fixed amount that advances the goal bar by that amount and marks one photograph as paid. No purchase carries content chosen by the viewer.
A purchase is credited to the goal bar whether or not a photograph results from it. If the broadcaster's capture is unavailable at that moment, the Bits still move the bar; what you do not get is that individual photo.
Bits spent are spent. There is no mechanism here to reverse a purchase, and refund requests are a matter for Twitch.

4. Broadcasters

If you run SHUTTERPARTY on your channel:

You decide what can be photographed. The extension photographs the scene you nominate, and only while the scene on air is one you allowed. Choosing what goes into that scene, and keeping out of it anything you do not want captured, is your responsibility.
Photographs appear on a public broadcast. Anyone watching can see, record and redistribute them. The extension cannot control what happens to a picture once it is on your stream.
Saving photographs to your own disk is off until you turn it on. Those files are yours and are governed by your own arrangements with the people who appear in them.
What a photograph contains is decided when you build the capture scene, not when you restrict the button. The scene you nominate is photographed whole — every source in it that is switched on, whether or not you were looking at it. Build a scene that holds only what you are willing to have photographed. The setup page lists what is in the one you chose, so that this can be checked before a viewer presses rather than after.
Nothing is photographed while you are off air. The extension is on your channel page whether or not you are streaming, so a viewer can press at any time — but the shutter only works while OBS is streaming. Being connected to OBS is not the same as being on air.
Nothing is photographed until you have chosen which scenes the button works in. You may allow every scene, and that is a valid answer — but it has to be an answer. The extension cannot know which of your scenes you would rather not have photographed, and it will not guess: until you decide, the shutter stays closed.
You are responsible for complying with the law where you are, including the rules about photographing other people who appear on your stream. If someone else can appear on your broadcast, whether they agree to being photographed is a matter between you and them.

5. Acceptable use

Do not use this extension to harass anyone, to capture people who have not agreed to appear, or to produce material that Twitch's Community Guidelines prohibit. We may withdraw the extension from a channel that does.

6. Availability

The extension depends on Twitch, on Cloudflare, and on the broadcaster's own computer being switched on and configured. Any of them can be unavailable. We provide the extension as it is, without a guarantee that it will work at any given moment.

7. What is in a photograph

The picture is taken by your computer, from a scene you nominated, while a scene you allowed is on air. Every one of those is set by you and none of them is visible to us: this service relays "somebody pressed the button" and never receives an image. We therefore cannot know, check or influence what any photograph contains.

It follows that what appears in a photograph — anything in the scene you chose, anyone who walks into frame, anything a viewer recognises — is yours to control and yours to answer for. The controls exist for that: the capture is a scene rather than a source, the button can be limited to scenes you name, and it can be stopped outright from your dashboard at any moment.

8. Liability

The extension is provided as is and as available, without warranties of any kind, whether express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

To the extent the law allows, we are not liable for any loss arising from use of the extension, including loss arising from what a photograph contains or from where it is subsequently seen or shared. Nothing here limits liability that cannot be limited by law — including liability for death or personal injury caused by negligence, and for fraud.

9. Changes

These terms may change. The date at the top reflects the current text, and material changes will be noted in the extension's version notes.
